Family law cases have a tendency to be very emotionally charged and stressful. If you are involved in a divorce, child custody or visitation case, you need an attorney who will assert your rights and will give you the insight to help you make an informed decision about your case. Diehl & Hubbell can guide you through your domestic relations case, protecting both your financial and parental interests. We offer customized legal representation to help you achieve an outcome that works for both you and your family.

Diehl & Hubbell handles all types of family law cases in Cincinnati, Ohio and throughout Southwest Ohio. We represent clients on a range of domestic relations matters, including contested and uncontested divorce, property, and asset division (including business assets), requests for alimony or spousal support, child custody, visitation and support orders, contempt of court issues, and post-decree modifications.  We are skilled at a number of alternative dispute resolution techniques to help you resolve the case in a more cost-effective and less stressful manner. We are often able to present creative solutions to our clients to help them avoid the time, cost and stress of a lengthy trial process.

Divorce

For both contested and uncontested divorces, Diehl & Hubbell will examine the unique facts of your case to determine how to move forward. We will walk you through each stage of an Ohio divorce proceeding, from the initial separation to custody arrangements, property division, and alimony. Whatever your specific concerns about your divorce are, our attorneys will work with you to ensure that each issue is properly addressed. If your divorce involves division of property, we will work to ensure that your assets — including businesses and professional properties — are protected.

Child Custody

Child custody issues can come up at any time, from a divorce or break-up to a change of circumstances after a child custody order is already in place. At Diehl & Hubbell, we understand that our clients’ primary concern is the welfare of their children. We'll strategize with you to find a solution that protects both your children and your parental rights.

Ohio law provides guidance to courts for how child custody and visitation should be determined. All relevant factors will be considered, with the goal of protecting the best interests of the child. A judge will look at what each parent wants for the child, the child’s desires (if they are of sufficient age), how the parents have acted, the optimal living arrangement for the child and any issues involving violence or abuse. Ohio law does not give a preference to either fathers or mothers. Diehl & Hubbell will work within this framework to develop a custody plan that suits your family’s needs — and protects your legal right to parent your children. In most cases, child custody and visitation issues are best resolved through negotiation or mediation, rather than through the courts. We will work to find a solution to your child custody matter without going to trial, but if necessary, we will aggressively litigate your case at trial.

Child Support

For both custodial and noncustodial parents, child support can be an ongoing issue and topic of argument. Regardless of whether or not their children live with them, parents have a legal obligation to financially support their children. In Ohio, unpaid child support can lead to wage garnishment, license suspension, reporting to credit bureaus and even jail time. Diehl & Hubbell represents custodial parents and non-custodial parents on issues involving child support. For custodial parents, we can challenge child support determinations that are insufficient to support your child. For non-custodial parents, we can seek modifications of your child support obligations if your financial circumstances have changed to avoid being found delinquent on your support obligations.
