Child Custody

Child custody issues can come up at any time, from a divorce or break-up to a change of circumstances after a child custody order is already in place. Ohio law provides guidance to courts for how child custody and visitation should be determined. All relevant factors will be considered, with the goal of protecting the best interests of the child. A judge will look at what each parent wants for the child, the child’s desires (if they are of sufficient age), how the parents have acted, the optimal living arrangement for the child and any issues involving violence or abuse. Ohio law does not give a preference to either fathers or mothers. Diehl & Hubbell will work within this framework to develop a custody plan that suits your family’s needs — and protects your legal right to parent your children. In most cases, child custody and visitation issues are best resolved through negotiation or mediation, rather than through the courts. We will work to find a solution to your child custody matter without going to trial, but if necessary, we will aggressively litigate your case at trial.

For both custodial and noncustodial parents, child support can be an ongoing issue and topic of argument. Regardless of whether or not their children live with them, parents have a legal obligation to financially support their children. In Ohio, unpaid child support can lead to wage garnishment, license suspension, reporting to credit bureaus and even jail time.
